Yes updating will re flash your DVD drive as your on such an old Dashboard, however you can re flash once updated. Yes you might get a flag or ban, there is always a risk with a modded console. However i dont think many people have been banned in the last 3+ years for burned games, only people who have played them early on live.
Thx for help , sadly i tried the update before saying will re flash. The update didn't continued after "Updating System" I was was stuck on that.
