I'm not overreacting, it is illegal content and Microsoft do have the rights to take action against websites distirubting illegal pre production materials. It's best to stay on the safe side.

It's not on the digiex server and is on a file hosting site. They can request that the link be taken down/removed from the site. Digiex isn't going to be taken down because of it. They know it's going to spread like a wildfire so i'm sure that they have little to no interest in trying to remove the links, especially since it'll only work on a Dev Kit anyways.
