Question about CFW on 3ds

How do I check a second hand 3ds is hacked? Also, is it safe to update a 3ds with a custom firmware on it?
 
Hold select and power the 3DS on, if you see the LumaCFW menu then you have CFW. You'll probably see homebrew on the homescreen if you do have CFW anyway.
