Internet access is in no way required to use a Kinect device when they are released. Your console isn't permanently banned but won't be able to regain access to Xbox Live until the dashboard is released officially in November.

when the dashboard is released if yuo updated with a modded drive yr console gets a flag and ms bans you. if you un mod the drive, update then remod you can then still play backups

Even if you download the update offline it will go through its certain checks for flash drives. If it notices your drive is flashed it will be logged on the 360 and the next time you log into live will be sent to them. So you are even flagged offline.

The only improvements are for Xbox Live purposes so its rather pointless to update to 12590 if you don't have live.

Nope your 360 has to download it from Xbox Live.
